📌簡介Abstract：

依據移民法第16條第4項的規定「中華民國一百零五年六月二十九日以前入國之印度或尼泊爾地區無國籍人民，未能強制其出國，且經蒙藏事務主管機關組成審查會認定其身分者，移民署應許可其居留。」這些無國籍者的身份查驗與認定，台灣的政府採取的是來台持有的護照認定，而忽略了難民在前入國的生活以及人權的議題。

In accordance with Article 16, paragraph 4 of the Immigration Act, "For stateless individuals from India or Nepal who entered the Republic of China before June 29, 2016, and were not compelled to leave the country, and whose identity has been confirmed by a review committee composed by the competent authority for Mongolian and Tibetan Affairs, the National Immigration Agency shall grant them residency." The verification and identification of these stateless individuals by the Taiwanese government are based on the possession of passports upon entry to Taiwan, overlooking the issues related to refugees' living conditions and human rights at the time of their initial entry.

本工作坊將針對當前滯台藏人向台灣政府提出訴訟的個案，邀請相關的法律人士、協助處理的NGO組織代表、台灣國家人權委員會的委員、以及在台藏人分別從難民生活的處境、公民身份的多元性、人權議題等面向，呈顯當前台灣法律面對難民審理的限制，並思考如何從這些案例促進台灣對難民人權的保護。

This workshop will focus on cases of Tibetan individuals currently residing in Taiwan who have initiated legal actions against the Taiwanese government. It will invite relevant legal experts, representatives from NGOs assisting with these cases, members of the Taiwan National Human Rights Commission, as well as Tibetan individuals in Taiwan, to discuss various aspects such as the challenges refugees face, the diversity of their citizenship status, and human rights issues. The aim is to highlight the current limitations of Taiwan's legal process for handling refugees and to explore ways to enhance the protection of refugee rights in Taiwan based on these cases.

Reference Material:

Three Tibetan individuals residing in Taiwan applied for residency, but the National Immigration Agency found that they all held Nepalese citizenship, and therefore, they were not stateless. Their applications were rejected, and the three individuals filed a lawsuit. The Supreme Administrative Court ruled against the three individuals, upholding their rejection.
